What sets Delaware gas prices

In the EIA’s July 2026 (revised August 2026) table of motor fuel taxes, Delaware’s state taxes and fees on gasoline total 23.0¢ a gallon, the 8th-lowest of the 50 states and D.C. The 51-jurisdiction average is 33.8¢, and the federal tax adds 18.4¢ everywhere. Delaware’s 23¢ excise rate took effect on January 1, 1995, and has not changed since. The state also taxes gross receipts from petroleum sales under its Hazardous Substance Cleanup Act, at a rate of about 1.2 percent, which the EIA lists separately from the per-gallon figure.

Delaware is one of the few East Coast states with a refinery. The Delaware City refinery, operated by a PBF Energy subsidiary, has crude distillation capacity of 171,000 barrels a day, according to the EIA’s January 2026 survey. The state also sits beside the Philadelphia-area refining and terminal complex on the Delaware River. All three counties require federal reformulated gasoline: the EPA lists Kent and New Castle in the Philadelphia–Wilmington–Trenton area and Sussex as a covered area of its own.

In the EIA’s annual series, Delaware has stayed close to the national average. Its average gap was 1.7¢ below the U.S. figure in the 1970s and from 1.1¢ to 7.2¢ above it in each decade since. Its rank has moved more than its gap: 9th-cheapest of 51 in 1980, 49th in 1990, 32nd in 2000, and 31st in 2024. The highest annual average is $3.93, in 2022, 3.9¢ above the U.S. average; adjusted for inflation the peak was 2012, at $5.04 in 2025 dollars. The largest one-year increases were in 1980 (40.6%) and 1979 (38.2%), and the largest declines in 2009 (27.9%) and 2015 (27.6%).
