How the tax works

Three parts, reset every July

Maryland’s gas tax has been built from three pieces since the Transportation Infrastructure Investment Act of 2013. The first is a base excise of 23.5¢ a gallon. The second grows with the Consumer Price Index: each July 1 the Comptroller multiplies the rate by the year-over-year change in CPI, with any single-year increase capped at 8 percent. The third is a sales and use tax equivalent, applied to the average wholesale price of gasoline, so that part moves up and down with fuel prices. As of July 1, 2026, the EIA lists the CPI component at 10.4¢ and the sales-tax-equivalent component at 12.7¢ a gallon. A small oil transfer fee is also charged on oil brought into the state.

The combined rate changes every July. On July 1, 2026 it rose by 0.6¢ to 46.6¢ a gallon, the first increase after two years of small declines. The CPI change used that year was 2.8 percent.

In the EIA’s July 2026 (revised August 2026) table, Maryland’s total of 46.8¢ is the 8th-highest of the 50 states and D.C. The 51-jurisdiction average is 33.8¢. For Maryland pump prices, see Maryland gas prices.
